HOA Fines by State: Know Your Rights

One of the most important things to know about HOA fines is that many states cap them. If your HOA is fining you beyond what the law allows, you have an automatic defense.

Florida leads the pack with strict protections. Under Fla. Stat. § 720, the maximum fine is $100 per violation per day, with an aggregate cap of $1,000. An independent committee (not the board alone) must ratify the fine. If your Florida HOA fine exceeds these limits or wasn't approved by an independent committee, it's unenforceable.

California's Davis-Stirling Act was just amended. Effective January 2025, AB 130 caps HOA fines at $100 per violation, no escalation. The fine schedule must be adopted by the board and distributed annually to all members. If your California HOA didn't provide you a fine schedule before imposing the fine, that's a defense.

Texas takes a different approach. Instead of capping fines in dollars, Texas requires a 30-day cure period. Your HOA must give you 30 days to fix the violation before imposing any fine. If they fined you without this cure period, they violated state law.

Arizona similarly requires notice and hearing before any fine. The Arizona HOA Ombudsman offers free dispute resolution, a service most homeowners don't know exists.

Most other states don't cap fines in dollars but require notice, hearing, and uniform enforcement. If your state isn't listed here, that doesn't mean you're defenseless—it means your state law likely focuses on procedural protections instead of dollar caps.
